Terms of Service

1. Acceptance of Terms

By creating an account, accessing the demo, or using any part of FaunaDoc AI, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using FaunaDoc AI on behalf of a veterinary practice or business, you represent that you have the authority to bind that entity to these terms.

If you do not agree to these terms, do not use FaunaDoc AI.

2. Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your login credentials and authentication tokens
• All activity that occurs under your account, including activity by your team members
• Ensuring your team members have appropriate roles and permissions for their responsibilities
• Notifying us immediately of any unauthorized access or security breach
• Keeping your contact information and billing details up to date

FaunaDoc AI is not liable for any loss or damage arising from unauthorized use of your account. You accept full responsibility for the actions of anyone who accesses your account.

3. Subscription & Billing

FaunaDoc AI offers month-to-month subscriptions with no long-term commitment. Billing details are:

• Billing Cycle: Subscriptions are billed monthly on the date you first subscribed. Annual billing is available at a discounted rate when purchased upfront.
• Payment: Payments are processed by Stripe. You authorize Stripe to charge your payment method on file for all subscription fees. FaunaDoc AI does not store payment card details.
• Upgrades & Downgrades: You may upgrade your plan at any time — the change takes effect immediately and you are charged a prorated amount. Downgrades take effect at the start of your next billing cycle.
• Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
• Failed Payments: If a payment fails, we will notify you and attempt to collect the payment. After 14 days of failed payment, your account may be suspended and eventually terminated.

4. Acceptable Use

You agree not to use FaunaDoc AI to:

• Store, process, or transmit any content that is unlawful, defamatory, or violates any third-party rights
• Upload or transmit viruses, malware, or any other harmful code
• Attempt to gain unauthorized access to any FaunaDoc AI system, user account, or data
• Use automated tools (scrapers, bots, crawlers) to access the platform without prior written authorization
• Resell, redistribute, or sublicense FaunaDoc AI access without our written consent
• Use the platform for any purpose that violates applicable veterinary practice regulations in your jurisdiction

We reserve the right to suspend or terminate accounts that violate these terms.

5. Service Availability

FaunaDoc AI is provided as-is and as-available. We strive to maintain high uptime but do not guarantee uninterrupted access. Service availability may be affected by:

• Scheduled maintenance (we will provide at least 48 hours' notice when possible)
• Emergency maintenance or security patches
• Third-party service provider outages (OpenAI API, Stripe, cloud infrastructure)
• Force majeure events beyond our control

We do not offer service credits for downtime. We will make reasonable efforts to restore service as quickly as possible following any disruption.

6. Diagnostic Assistance

FaunaDoc AI's AI diagnostic engine provides ranked differential diagnoses based on the information you input. These suggestions are generated by machine learning models and may be incomplete, inaccurate, or inappropriate for a specific case.

You acknowledge that:

• AI-generated diagnostic suggestions are advisory only and do not constitute a veterinary diagnosis
• FaunaDoc AI is not a licensed veterinary medical device and is not intended to replace veterinary consultation
• You are solely responsible for any diagnostic or treatment decisions made using information from FaunaDoc AI
• Veterinary care decisions must be made by a licensed veterinarian in accordance with applicable laws and regulations

7. Intellectual Property

All content, features, and functionality of FaunaDoc AI — including but not limited to the AI diagnostic engine, condition database, user interface, and documentation — are owned by FaunaDoc AI and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of all data you upload to FaunaDoc AI. We claim no ownership over your patient records, practice data, or any other content you provide.

You are granted a limited, non-exclusive, non-transferable license to use FaunaDoc AI for its intended purpose of veterinary practice management and clinical decision support.

8. Data Ownership

You retain full ownership of all data you enter into FaunaDoc AI, including patient records, clinical notes, diagnostic images, and practice information. We do not claim any ownership rights over your data.

You grant us a limited license to use your data solely for the purpose of providing the FaunaDoc AI service to you — including hosting, displaying, and generating diagnostic suggestions.

Your patient data is never shared with other practices or used to train AI models for other customers.

9. Security & Access

We implement reasonable technical and organizational measures to protect your data, including encryption in transit and at rest, access controls, and regular security reviews. Details are provided in our Privacy Policy.

You are responsible for maintaining the security of your account credentials and ensuring your team follows good security practices (strong passwords, no credential sharing, logout after sessions).

Report any security vulnerabilities or data incidents to us immediately at faunadoc-ai@polsia.app.

10. Limitation of Liability

To the maximum extent permitted by law, FaunaDoc AI and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, revenue, data, or business opportunities — arising from your use of or inability to use FaunaDoc AI.

In particular:

• Diagnostic Accuracy: FaunaDoc AI is not liable for any damages arising from reliance on AI-generated diagnostic suggestions. The platform provides clinical decision support, not veterinary medical advice.
• Service Interruptions: FaunaDoc AI is not liable for damages arising from service downtime, data loss, or inability to access the platform.
• Third-Party Services: FaunaDoc AI is not liable for damages arising from the performance, errors, or unavailability of third-party services including Stripe and OpenAI.

Our total liability for any claim arising from your use of FaunaDoc AI is limited to the total subscription fees you have paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FaunaDoc AI, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of FaunaDoc AI in violation of these terms
• Your violation of any applicable law or regulation
• Any content or data you upload to the platform
• Any diagnostic or treatment decision made based on FaunaDoc AI output

12. Termination

By you: You may terminate your account at any time from your account settings. Upon termination, your account enters a 90-day grace period during which you can export your data. After 90 days, your account and all associated data is permanently deleted.

By us: We may suspend or terminate your account immediately, without notice, if we reasonably believe you have violated these terms, engaged in fraudulent activity, or posed a security risk. We may also terminate accounts that have been inactive for more than 12 months.

13. Governing Law

These terms are governed by the laws of the United States. Any dispute arising from these terms or your use of FaunaDoc AI will be resolved in the courts of the United States.
